‎Tinubu’s reversal of Osun account freeze triggers EFCC independence debate

President Bola Tinubu’s directive ordering the Economic and Financial Crimes Commission to vacate the freezing of Osun State Government’s account has ignited a nationwide debate over the independence of Nigeria’s anti-corruption agencies, with opposition politicians, lawyers, civil society groups and citizens sharply divided over the development.

‎The controversy erupted after the EFCC restricted withdrawals from one of Osun State’s statutory allocation accounts as part of an investigation into the alleged diversion and laundering of about N11bn in public funds.
‎
‎However, Tinubu on Thursday ordered the commission to approach the court and withdraw the action, citing concerns that the timing of the restriction, barely days before the August 15 governorship election in Osun State, could create the impression of federal interference in the electoral process.
‎
‎The President said he was “deeply embarrassed” by the timing of the EFCC’s action and stressed that no federal institution should take steps capable of undermining public confidence in the credibility of the poll.
‎
‎The presidential intervention has since sparked fierce political reactions, with the opposition African Democratic Congress and former Vice President Atiku Abubakar arguing that the directive exposed the extent of presidential influence over anti-corruption agencies.
‎
‎The ADC questioned Tinubu’s reference to a court order authorising the account restriction, noting that the EFCC had publicly justified its action based on statutory powers rather than any judicial authorisation.
‎
‎Atiku, through his spokesman, Phrank Shaibu, said the President’s order had weakened claims that the EFCC operated independently of the Presidency, arguing that if Tinubu could direct the agency to discontinue proceedings in the Osun matter, similar influence could be exercised in other cases.
‎
‎Amid the controversy, the Osun State Government filed a suit before the Federal High Court in Abuja seeking to nullify the account restriction and demanding N2bn in damages from the anti-graft agency.
‎
‎Governor Ademola Adeleke’s administration also rejected allegations that about N11bn was diverted, describing the claim as an afterthought intended to justify what it called an unlawful action.
‎
‎The dispute has further fuelled public anger against EFCC Chairman Ola Olukoyede, with many Nigerians on social media calling for his resignation or removal. Critics accused the commission of damaging its credibility and creating the perception of political interference ahead of the governorship election.
‎
‎Despite the backlash, the EFCC maintained that its action was lawful and unrelated to politics, insisting it acted within its statutory mandate to protect public funds after detecting suspicious transactions linked to the state account.
‎
‎Legal experts and civil society leaders offered mixed reactions, with some commending Tinubu’s intervention as necessary to protect electoral integrity, while others argued that the episode underscored the need for clearer legal boundaries between anti-corruption enforcement and constitutional safeguards for state governments.
‎
‎As political tensions continue to rise ahead of the Osun governorship election, the dispute has shifted beyond the frozen account itself to broader questions about the balance between anti-corruption enforcement, electoral fairness and the operational independence of federal institutions.
